Terms of Service

By accessing this Web site and related services (including but not limited to the GetYourIDX API and IDX feeds), you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing GetYourIDX.com services. The materials contained in this Web site are protected by applicable copyright and trade mark law.

Use of active listing information on internet.
You may display on your public Web site active property listings from GetYourIDX under the following terms: -

  1. Participants and subscribers shall not display confidential information fields, as determined by the MLS at the MLSs' sole discretion, such as that information intended for cooperating brokers rather than consumers.
  2. All listings on a participant or subscriber's site displayed by framing or other electronic means, shall identify the name of the listing firm and the name of the listing agent in a manner designed to easily identify such listing firm or agent.
  3. Participants and subscribers shall not modify the information displayed pursuant to these MLS rules.
  4. Information displayed shall indicate the source of the information being displayed and the most recent date updated. Results may be automatically cached by the web site for a period of no more than 24 hours, the caching must not be used for any other reason other than that of serving subsequent searches on the web site, and must not be downloaded and archived in whole or part including backups as part of a disaster recovery operation.
  5. No more than 25 listings shall be displayed per page as a result of a property search. There is no maximum requirement for the total search.
  6. A notice is required on each page where listing data is displayed indicating that the "information is deemed reliable, but not guaranteed."
  7. A copyright notice of the MLS on each page where listing data is displayed is required. (the correct notice is provided in all responses from the GetYourIDX API)
  8. Sharing of the MLS compilation with any third party not authorized by the MLS is prohibited. Participants and subscribers shall indicate on their websites that the information being provided is for consumers’ personal, non-commercial use and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing.

Your account may be temporarily disabled if any part of these terms are violated. GetYourIDX will notify the account holder within a reasonable time as to why their account has been disabled to allow the account holder to make the required changes before requesting their account is reactivated. Under no circumstances will compensation be awarded for any time an account has been temporarily disabled due to violation of these terms. This license shall automatically terminate if you continually violate any of these restrictions and may be terminated by GetYourIDX at any time.

The materials on GetYourIDX's Web site are provided "as is". GetYourIDX makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, GetYourIDX does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet Web site or otherwise relating to such materials or on any sites linked to this site.

Limitations
In no event shall GetYourIDX or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on GetYourIDX's Internet Web site, even if GetYourIDX or a GetYourIDX authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Revisions and Errata
The materials appearing on GetYourIDX's Web site could include technical, typographical, or photographic errors. GetYourIDX does not warrant that any of the materials on its Web site are accurate, complete, or current. GetYourIDX may make changes to the materials contained on its Web site at any time without notice. GetYourIDX will make every attempt to update its data in line with its responsibilities set forth by the MLS. All data provided by GetYourIDX is deemed reliable however is not guaranteed.
